Terms and Conditions of Service

Tourney Clean is pleased to provide laundry service to our customers, subject to compliance with and acceptance of the terms and conditions set forth below. Please read the following provisions carefully. Use of the Tourney Clean service indicates agreement to be bound by the terms and conditions contained herein. If you do not so agree, you should inform us and cease using the service immediately.

This agreement is strictly between Tourney Clean and its customers and does not in any way constitute or imply any relationship with any other parties.

Delivery Schedule:

Laundry pickup must be scheduled in advance by the customer. Pickup and delivery will take place each week on Sunday through Saturday, except on certain holidays determined by Tourney Clean in its sole discretion. Tourney Clean reserves the right to determine the pickup and delivery times in its sole discretion and reserves the right to reschedule pickup and delivery times upon prior notice to the customer. .

Pick Up and Delivery, Procedure and Terms:

Tourney Clean will provide the customer with laundry bags and uniform loops. Tourney Clean reserves the right not to pick up items that are not in these bags on uniform loops,but may decide to pick up such items in its sole discretion. The customer agrees not to include any of the following that are in or attached to any of the items to be cleaned or inside any of the customer’s laundry bags: (i) non-washable items, (ii) items that are labeled for hand washing and/or dry-cleaning only, or (iii) any other items not meant for laundering. The customer is responsible for any and all damage caused by any items left in the customer’s clothing or laundry bag that cause damage to the clothing of any customer, the cleaning machines, or any other property of Tourney Clean or its customers. Tourney Clean is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer for pickup or delivery. The customer is responsible for ensuring that his/her Tourney Clean laundry bag is in the possession of a Tourney Clean employee, and for initialing the pickup and delivery terms unless otherwise instructed by Tourney Clean.

Missed/Unattended Delivery or Pick Up:

If the customer misses a scheduled pickup, the customer will forfeit the service for that day and will not be reimbursed. In order to accommodate the customer for the missed day of service, Tourney Clean will allow the customer to wash the same amount of uniforms on a future order, free of additional charges. For example, if a customer who paid for ten (10) players misses a pickup, they may have ten (10) players’ laundry cleaned on their next order.

Payment:

The customer must pay the agreed-upon charges prior to service. Tourney Clean will not provide a refund for any under-utilization of services. Except as described in the next two paragraphs, all sales are final and all payments are non-refundable. In the event that the customer’s Tourney Clean laundry bag contains more uniforms than he/she paid for, a fee of $8.00 will be charged for each additional player’s uniform loop. The customer hereby grants Tourney Clean the right to withhold the customer’s clothing until payment is made for the excess player’s laundry. Tourney Clean reserves the right to charge payment for excess laundry to the customer’s credit card on file if the customer does not respond, for any reason, within thirty (30) days of a good faith effort by Tourney Clean to notify the customer that such payment is due, or if Tourney Clean is not able to reach the customer within thirty (30) days.

Refunds:

A customer who has signed up for laundering will have the right to cancel service within 6 hours of signing up for Tourney Clean service and receive a full refund. Tourney Clean shall have no obligation to refund any amounts paid by the customer, but it may choose to do so in its sole and absolute discretion. If Tourney Clean agrees to pay a refund after such 6 hour period, Tourney Clean will refund the amount paid by the customer less (i) a five percent (5%) processing fee.

Garment Care:

Tourney Clean will use reasonable efforts to maintain a high quality cleaning service. Tourney Clean accepts no liability for damage due to normal cleaning of items without care instructions, and accepts no liability for items treated in accordance with the care labels or other instructions provided. Tourney Clean accepts no liability for “special care” items that include special attention to be cleaned or that do not have care instructions. Tourney Clean is not responsible for clothing bleeding, shrinking, or otherwise changing as a result of normal washing procedures. Precautions will be taken to alleviate these problems if possible. Tourney Clean reserves the right to refuse to clean any garment. Tourney Clean does not guarantee the removal of all stains. Tourney Clean will have its cleaning service re-clean items that, in its sole discretion, were not properly cleaned and have not been worn since they were cleaned. Tourney Clean is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or laundry bags such as money, jewelry, or any other item. The customer agrees not to leave such items in its clothing or in its laundry bags.

Loss or Damage:

In the rare instance that your garment is lost or damaged by Tourney Clean, we will issue you a refund or credit for the value of that garment, as specified in the National Fair Claims Guide from the International Fabricare Institute (“IFI”). This guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, the customer can attest to the age but Tourney Clean, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), Tourney Clean may use the replacement cost of a comparable item currently available. Notwithstanding the foregoing, the maximum reimbursement for each individual item is $200, and the maximum total reimbursement per customer is $1000. Although Tourney Clean is not liable for damage or loss due to the fault of its third-party cleaners or service providers, we may, in our sole discretion, chose to reimburse the customer in these events pursuant to the IFI standards described above.

We are not liable for any preexisting damage to garments. If we find any preexisting damage or have a concern about the colorfastness, or the age or weakness of the fabric, we will contact you to obtain your approval before proceeding to care for the item. If we are unable to obtain your authorization in a timely manner, then we may return the item without cleaning it.

Missing or damaged items must be reported to us within three (3) days of delivery of the item(s). If you believe that Tourney Clean is in possession of an item but we have no record of its pickup, we request that you inform us immediately so we can start an investigation and you can search for the item. If, after seven (7) days, the item has not been found, we may compensate you for the loss of the item in accordance with the IFI guide, at our discretion.

Use of Third-Party Service Providers:

Tourney Clean washes and cares for your items. When demand exceeds our internal capabilities, in order to meet our guaranteed delivery schedule, Tourney Clean or its associates will deliver the customer’s items to and from a laundering service of Tourney Clean’s choice. Tourney Clean reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, in its sole discretion, without notice to the customer. Tourney Clean is not responsible for, and will not be held liable for, any damage or loss due to the acts or omissions of its vendors, third party outsourcers, or service providers.

Disclaimer:

Tourney Clean liability shall be limited to general money damages in a maximum amount not to exceed the charges for the term of service paid by the customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of Tourney Clean liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer’s exclusive remedy. In no event will Tourney Clean be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not Tourney Clean knew or should have known of the likelihood of any such loss or damages. Tourney Clean disclaims all warranties, express or implied, with respect to the services rendered to the customer.

Venue and Choice of Law:

Any suit involving any dispute arising between Tourney Clean and the customer may only be brought in the State of Indiana. Tourney Clean and the customer hereby irrevocably consent to the exercise of personal jurisdiction and venue by any such court with respect to any such proceeding. These terms of service and the relationship between the parties shall be interpreted, construed, and governed according to the internal laws of the State of Indiana, without reference to its choice of law rules.
